This regulation also aims at making the sector more efficient and transparent. ET Realty explores how this reform will affect the real estate sector all over</p>
<p>The central government is working on a model real estate regulation bill to provide guidelines to facilitate growth and promotion of healthy and transparent, efficient and competitive real estate sector in the country, said the housing and urban poverty alleviation minister Kumari Selja. This is a welcome move and will help the sector in becoming efficient and competitive. However, developers feel the government should form a separate regulator on the lines of Securities and Exchange Board of India (SEBI) to regulate the sector.</p>
<p>Addressing a conference on real estate, the minister said Indian real estate market is unorganized and fragmented and that most of property transactions are based on certain perceptions and not necessarily on sound business principles. In this, customer satisfaction is low and redressed procedure is long and cumbersome. This has created problems for both buyers and developers. As end users are not sure of delivery of a house by builders on time, they don’t want to risk a purchase by taking a loan from the bank.</p>
<p>Apart from this, many buyers are not even sure of the specifications, which developers promise while selling them the houses/flats. Worse still, when developers do not deliver on time or stick to the promised specifications while selling, buyers do not know where to for redressed. Going to a court is not only time consuming but also expensive.</p>
<p>This has forced buyers to either defer their purchase or to go for completed projects. But, this apprehension of end users has affected genuine developers as well, which have a plan and required finances to complete a project. However, in the last couple of months, end users have started showing interest in buying new projects. But, they want to buy in the projects of reputed developers alone. This has created problem for the new but good developers.</p>
<p>A senior developer says if the sector is well regulated, the role of brokers and investors can be reduced. In most of the cases, investors, who have better understanding of the sector and who can invest time and money to know about developers, invest at the early stage of implementation of a project and make easy money by selling them to end users at high prices when the project comes to a close? The end users, on the other hand, are comfortable in buying a house when projects are close to completion, hence making the sector over dependent on investors. Consequently, in the last one year of market downturn, the entire real estate sector came to a screeching halt as investors disappeared from the market. But, had the sector been well regulated, end users would have been bold enough to buy at the early stage of project implementation. This would have helped developers also.</p>
<p>However, another problem in regulating the sector is that it comes under the state subject as well. Thus, a senior official says nothing much can be done unless state governments show interest. Haryana Government has already passed an act to regulate the sector. But, the results are not encouraging, thus far. It was assured all the stakeholders that the government will accord full cooperation and support to encourage affordable housing.</p>
<p>She said the housing sector in India holds tremendous potential and has positive impact on the social and economic development of the country. In 2006-07 the sector was about 4.5% of country&#8217;s Gross Domestic Product and comprised approximately 7% of the total urban workforce. Housing is the largest component of the construction sector and central to economic growth. However, provision of affordable housing for all is a complex problem with challenges emerging from many facets of urban sector. The minister said there are many impediments to the growth of affordable housing land and capital being the two key constraints.</p>
<p>To increase the stock for affordable housing the focus has to be on augmenting land supplies. Kumari Selja said the issue is a critical one and requires a number of measures such as alternative methods of land assembly, development and disposal to be pursued, check on prices of urban land, encouraging public-private partnership, promoting intense use of land-higher densities, revision in Floor Area Ratio or Floor Space Index and change of norms to suit local situations, discouraging speculation in land development, and allotment or disposal process to check rising prices of land.</p>

			<content:encoded><![CDATA[<p><strong>FOREIGN DEBT STILL SEEPING INTO REALTY</strong></p>
<p>Foreign debt, banned in real estate, is finding its way into property firms as bankers and lawyers help builders cobble together new deals to raise money.</p>
<p>Even though foreign loans—better known as external commercial borrowings—are not permitted in construction, property firms have spotted a mechanism where the debt can be provided by foreign institutional investors (FIIs) registered with Sebi. No rules are broken and the deals, involving a three-way transaction, come across as normal private placements in the corporate bond market.</p>
<p>The process begins with a real estate company placing nonconvertible debentures (NCDs) with a local entity, such as a nonbanking finance company (NBFC). The next step involves listing the debt security, soon after which an FII steps in. Once the NCD is listed on a stock exchange, the NBFC offloads the paper to a foreign fund. Since FIIs cannot invest in unlisted debt, the NBFC warehouses the NCD till the paper is listed and then recovers the money by selling the debentures to a foreign fund.</p>
<p>The two transactions are part of a back-to-back deal struck between the firm issuing the NCD, the local NBFC and the FII. At least four developers—three from Mumbai and one from Bangalore—have risen over Rs 1,000 cr in the past few months through this route.</p>
<p>&#8220;It does not directly violate the Press Note on foreign investment in property, and such FII investment is within the overall corporate bond ceiling applicable to foreign funds&#8230; but it&#8217;s against the spirit of the regulation,&#8221; admitted a senior banker who has advised one such NCD issue.</p>
<p>Indeed, a few foreign banks have made presentations to property firms on the convenience of such fund-raising which has become more attractive since the government plugged a loophole on the foreign direct investment (FDI) regulations in the real estate sector.</p>

			<content:encoded><![CDATA[<p>Tracy Kelly, President of Kelly Mortgage And Realty Inc. of Aliso Viejo, CA has seen during the last week in February, 2010 that rates for a Jumbo Mortgage have gone down by a full percentage point.</p>
<p>Rates on jumbo mortgages &#8212; loans of more than 9,750 in Orange County, California with highest-cost housing &#8212; shot up during the financial crisis as lenders and loan investors shunned loans that they considered a higher risk. Rates on big mortgages were especially high relative to those on smaller loans. Due to the high cost of homes in Orange County, CA this was bad news for home buyers.</p>
<p>The high interest rates for borrowers in Orange County, California&#8217;s expensive housing market made refinancing almost impossible for many Kelly&#8217;s clients. This is beginning to change as the jumbo-loan market is starting to return to normal.</p>
<p>Two weeks ago, the average interest rate on 30-year fixed-rate jumbos dropped to 5.79%, a nearly five-year low, according to rate tracker Informa Research Services of Calabasas. It edged up to 5.88% on Tuesday, still very attractive by historical standards. The average is down from well above 7% in late 2008.</p>
<p>Rates are even lower on so-called hybrid adjustable mortgages, on which the rate is fixed for, say, five years and then adjusts annually. For example a client with a five-year hybrid adjustable loan identical to his old one, except that now they would be paying about 5%, down from 6%.</p>
<p>Banks are also relaxing slightly some of their requirements for jumbo loans. That&#8217;s an encouraging sign because the market for jumbos, in contrast with the rest of the mortgage business, isn&#8217;t being propped up by our US government.</p>
<p>The lower rates and somewhat easier terms reflect newfound confidence among banks in the housing market. That&#8217;s because, by definition, jumbos are too big to be bought by Freddie Mac and Fannie Mae or to be insured by the Federal Housing Administration. Plus, the private market for mortgage-backed bonds dried up when the loan problems hit. So lenders making jumbo loans these days must be willing to take the risk of keeping them in their portfolios.</p>
<p>The maximum amounts for Freddie Mac and Fannie Mae &#8220;conforming&#8221; mortgages, and for FHA mortgages, are set by Congress. The cutoff for single-family homes was 7,000 from 2006 until February 2008, when lawmakers increased it temporarily to 9,750 in certain high-cost areas, including Los Angeles, Orange and Ventura counties. Conforming loans top out at 0,000 in Riverside and San Bernardino counties and 7,500 in San Diego County.</p>
<p>The increased upper limits, which have been extended until the end of this year, have created a three-tier system in expensive areas, mortgage professionals say: loans of up to 7,000, which are the easiest to obtain and carry the lowest rates; &#8220;conforming jumbos&#8221; from 7,000 to 9,750, which are somewhat harder to get and have slightly higher rates; and true jumbos, with the toughest standards and highest rates.</p>
<p>In the boom years of 2005 and 2006, interest rates were typically no more than a quarter of a percentage point higher on jumbo loans than on conforming loans, according to Informa Research. That widened as the mortgage meltdown intensified and home prices dropped in late 2007. The spread ballooned to nearly 1.7 percentage points in early 2009 after the entire credit system froze.</p>
<p>But this year the rate spread has narrowed to less than a percentage point. It could shrink more if conforming-loan rates rise as expected after the Federal Reserve wraps up a -trillion-plus program to support the market for conforming loans next month.</p>
<p>In addition to lower rates, down-payment requirements are being relaxed in some cases. For example, to write a jumbo loan in coastal areas of Los Angeles and Orange counties, Kelly Mortgage and Realty Inc. looks for a 20% down payment or that percentage of equity, down from 25% last year.</p>
<p>The reason: Tracy Kelly believes high-end home prices are stabilizing in those coastal counties. But lenders still requires higher down payments in the Inland Empire and other battered housing markets such as Florida, Nevada and Arizona, where prices for jumbo-size homes don&#8217;t appear to be stabilizing.</p>
<p>Jumbo loans remain much harder to get than before the credit crunch and recession. Borrowers typically must have a credit score of at least 700, compared with boom-era minimums in the 600s, though Tracy Kelly has noted that some lenders was again making sub-700 jumbos available.</p>
<p>Tracy Kelly sees that it is now a fact that, unless home buyers down payments are very large, borrowers must provide evidence of high income, have sizable bank accounts as a cushion against the unforeseen and occupy the houses themselves.</p>
<p>In Orange County, CA there are clear signs that the jumbo market has loosened. One is an increasing availability of &#8220;stated income&#8221; loans &#8212; those that don&#8217;t require proof of income &#8212; of as much as  million to borrowers with at least a 40% down payment. Also, instead of a true jumbo loan, some &#8220;piggyback&#8221; second loans are available again to help certain borrowers with 25% down payments pay for high-priced homes.</p>
<p>Despite the confidence in the market that such terms imply, lenders and mortgage investors are still dealing with piles of bad jumbos made during the boom.</p>
<p>Delinquencies of 60 days or more on prime jumbo loans that were packaged into securities jumped to 9.6% in January, up from 3.7% a year earlier, Fitch Ratings reported this month.</p>
<p>The jumbo delinquency rate in California climbed to 11.3% from 4.1% a year earlier.</p>
<p>For now, the jumbo market remains limited to the volume of loans that banks are willing and able to keep on their books. But there is hope for a return to private outside funding.</p>
<p>Although no jumbos have been turned into securities for at least two years, packages of delinquent jumbos have begun to be sold again to &#8220;vulture&#8221; investors, a sign that the secondary market for the loans may revive. Many brokers in Orange County see this as a positive sign.</p>

Under the new Metro links, existing Metro terminal at Sector 32 (City Centre) will be extended up to Sector 62, and further connect Gajipur (Delhi). <br /> This new Metro link will cover Gajipur, Kalyanpuri, Mayur Vihar Phase 1, Sarai Kale Khan, Moolchand, AIIMS, and Bhikaji Kame Place. And, through the new Metro link 2, Sector 18 will be extended up to NH-8. It will cover AIIMS, Okhla, Nehru Place, Malviya Nagar, and Vasant Kunj. This will further connect to Gurgaon and Faridabad via Central Secretariat and Badarpur. There is also a plan for both Noida and Greater Noida to be connected through a 29km-long elevated Metro track at a cost of around Rs 3037 crore.       </p>
<p> The Metro project is to be implemented in Ghaziabad in three phases. The first link to Vaishali is already underway. The 2.52-kmlong Metro line will originate from Anand Vihar, which directly links to Rajiv Chowk via Vi k a s Marg. The estimated cost of Anand Vihar-Vaishali Sector 4 line is Rs 300 crore. The UP government has already paid half of the amount to DMRC for the purpose. This route will go up to Indirapuram, which connects to Noida Sector 32 via Sector 62 further down. <br /> The extension of Vaishali-Indirapuram Metro route comes under Phase 2. For this, DMRC and GDA&#8217;s survey work has already been completed. Vaishali-Indirapuram will link to Mehrauli furthur via Noida crossing 62, CISF, Pratap Vihar, Dundahera and Shahapur in Phase 2. The length of this line is 16km. The total travel time to Rajiv Chowk is 35 minutes. <br /> In Phase 3, the Metro line will connect to the Ghaziabad bus stand to ISBT (Kashmiri Gate). The length of this line will be 12km. It will cost around Rs 1,800 crore. <br /> To improve the city-level infrastructure, Noida and Ghaziabad entered a new phase of cooperation. In Ghaziabad, road infrastructure has seen the plan for 17 flyovers, including three cloverleafs, to be implemented over five years. A MoU has been signed with UP State Bridge Corporation Ltd (which made the AIIMS and the Dhaula Kuan flyover in Delhi) for five more flyovers, including a cloverleaf at Meerut Road crossing. <br /> This follows the Metro plan to provide a network of new links and not just a token presence of the Metro line. The city will benefit from the 6- to 8-lane expressways linking Delhi to Meerut, Hapur, and Bulandshahar. All the three expressways, as well as the Delhi Metro Peripherique (planned on the lines of the Paris Peripherique) will touch the new development in Ghaziabad. <br /> The city is slated to have multiple projects like a number of shopping malls, multiplexes, and residential and commercial development. The Metro line touching Anand Vihar Bus Terminal is making good progress. Like Noida and Greater Noida Industrial Development Authority, GDA&#8217;s proposal of an express-highway linking Meerut Crossing to NH-24 will create integrated flyovers at all level crossings. In addition, the Delhi Metro service, the Northern Railway project (Integrated Railway-Bus Transport system) will make commuting between Ghaziabad and Delhi easy.</p>
